If I have already chosen the property I want to buy, how do I reserve it?

  • If you have already agreed a price with the owner, it is recommended to sign a deposit contract for 10% of the value of the property.

How long do I have to formalise the purchase and sale of the property?

  • Normally 30 to 45 days, although longer periods of up to 180 days are also agreed if needed. In any case, an agreement will always need to be reached between the buyer and seller.

Who chooses the notary?

  • If the purchase requires a mortgage, the bank will choose the notary. If this is not the case, the buyer usually does.

Who pays the costs of the sale and purchase?

  • All costs are borne by the buyer except for the capital gain, which is borne by the seller.

How much tax is paid on the purchase of a property in Madrid?

  • This tax will vary according to the price of the property in the deed and the rate of the region - in Madrid it is 6%. In the case of new developments, VAT will have to be paid, which corresponds to 10% and the Stamp Duty (Impuesto de Actos Jurídicos Documentados or IAJD), which in Madrid is 0.7%.
